RESIDENTS of Taman Bukit Minyak Utama are appealing to the Seberang Prai Municipal Council (MPSP) that the guard post that was removed by the council’s enforcement team be restored.
Tan Eng Lam, a representative of the residents, said the post at the entrance to the housing estate served as the base for the neighbourhood guards.
“We asked that we be allowed to have the post until there is a need to open the housing area’s thoroughfare for new project developments.
“We are saddened that the guard post was knocked down on Jan 9.
“Our security watch has been in operation for the past two years without any problems,” he said.
Taman Bukit Minyak Utama Rukun Tetangga chairman Chuah Eng Loey said the neighbourhood’s crime rate reduced significantly following the formation of the security watch.
He said the security post had also kept away Mat Rempit from racing in the neighbourhood at night.
The residents staged a peaceful demonstration on Monday to protest against the removal of the guard post by MPSP.
MPSP secretary Rozali Mohamud when contacted said the guard post was torn down as it was placed on the main road.
“(Taman Bukit Minyak Utama Rukun Tetangga) applied for the guard post but we rejected the application due to its location.”

GARIS PANDUAN PERANCANGAN SKIM “ GUARDED NEIGHBOURHOOD “
(DILULUSKAN MAJLIS PENUH BIL 454 (4/2012)

SYARAT-SYARAT PENYEDIAAN SKIM “ GUARDED NEIGHBOURHOOD “
- Maksima unit untuk skim ini tidak melebihi 300 unit.
- Permohonan melalui persatuan penduduk (RA) yang berdaftar dengan Jabatan Pendaftaran Pertubuhan (RoS).
- Semua premis kediaman yang hendak dijadikan sebagai GN mestilah telah mendapat Perakuan Kelayakan Menduduki (CFO) atau Perakuan Siap dan Pematuhan (CCC)
- Menyediakan dokumen lengkap mengenai persetujuan 2/3 penduduk

1. KAWALAN AM PERANCANGAN
 Skim GN hanya dibenarkan di kawasan bandar ( di dalam kawasan operasi PBT), khususnya di kawasan yang kurang selamat (mempunyai kadar jenayah yang tinggi berdasarkan rekod pihak polis).
 GN tidak dibenarkan jika di dalam kawasan kejiranan terdapat komponen-komponen kemudahan awam utama seperti sekolah,masjid, dewan orang ramai dan sebagainya serta jika merupakan kawasan laluan pengangkutan bas awam.
 PBT boleh menentukan bilangan unit rumah (minimum dan maksimum dalam sesuatu skim GN bagi memastikan ianya dapat dikawal dan diurus dengan berkesan.

2 SYARAT ASAS PENUBUHAN
 Cadangan menubuhkan GN perlu dimaklumkan kepada PBT yang berkenaan melalui persatuan penduduk (RA) yang berdaftar dengan Jabatan Pendaftaran Pertubuhan (RoS).
 Semua premis kediaman yang hendak dijadikan sebagai GN mestilah telah mendapat Perakuan Kelayakan Menduduki (CFO) atau Perakuan Siap dan Pematuhan (CCC).
 Cadangan untuk mewujudkan GN perlu mendapat persetujuan majoriti penduduk (ketua isi rumah) sebanyak 2/3 , tertakluk kepada tiada sebarang paksaan dan tekanan kepada penduduk yang tidak
bersetuju.
 Pihak persatuan penduduk perlu mengemukakan dokumen berkenaan dengan persetujuan penduduk dan lain-lain maklumat yang diperlukan kepada PBT dan pihak-pihak berkuasa yang berkenaan.

3 PEMBINAAN PONDOK PENGAWAL
 Saiz pondok pengawal hendaklah tidak melebihi 1.8 meter X 2.4 meter.
 Pondok pengawal hanya dibenarkan disedia atau dibina di kawasan bahu jalan (road shoulders) dan perlu dipastikan tidak menghalang lalulintas. Amalan pembinaan pondok pengawal di atas atau di kawasan tengah jalan adalah tidak dibenarkan.
 Jika cadangan binaan pondok pengawal di kawasan bahu jalan adalah berstruktur kekal (permanent structure), pemohon (persatuan penduduk) perlu memohon kelulusan Lesen Pendudukan Sementara
(TOL) daripada Pejabat Tanah Daerah (PTD) yang berkenaan. Peraturan ini adalah selaras dengan seksyen 65, Kanun Tanah Negara, 1965 (Akta 56).

4 PEMBINAAN PONDOK PENGAWAL
 Cadangan lokasi pondok pengawal perlu ditanda di dalam pelan yang sesuai dan perlu dikemukakan kepada PTD semasa mengemukakan permohonan TOL dan kepada PBT bagi permohonan permohonan permit atau kelulusan pembinaan sementara.
 Cadangan rekabentuk pondok pengawal perlu dikemukakan kepada PBT (Bahagian Bangunan) untuk mendapat permit atau kelulusan pembinaan sementara bagi pembinaan pondok pengawal. Pondok
pengawal hanya boleh dibina setelah mendapat permit atau kelulusan pembinaan sementara daripada PBT.

5 PEMBINAAN PONDOK PENGAWAL
 Rekabentuk bumbung dan fasad bangunan perlulah berharmoni. ‘manual boom gate’, kon dan papan tanda keselamatan boleh diberi pertimbangan untuk dipasang atau diletak di lokasi yang sesuai di jalan masuk berhadapan dengan pondok pengawal dengan syarat terdapat pengawal keselamatan bertugas mengawal sekatan tersebut selama 24 jam.

6 PEMBINAAN PAGAR
 Pembinaan pagar (perimeter fencing) mengelilingi kawasan sempadan skim kejiranan adalah tidak dibenarkan.

7 PENGAWAL KESELAMATAN
Syarikat pengawal keselamatan dilantik perlu berdaftar dengan Kementerian Dalam Negeri dan mematuhi syarat-syarat bagi pengambilan pekerja dan pengawal keselamatan.

8 PELEPASAN STATUS
Cadangan pelepasan atau pembubaran status GN kepada status asal (tidak berpengawal) oleh persatuan penduduk perlu dimaklumkan kepada PBT.

Below are the summary of Gated Community and Guarded Neighborhood Planning Guidelines (GP022) by Malaysia Town Plan Department (Jabatan Perancangan Bandar dan Desa Semenanjung Malaysia)

1. The need to obtain a better level of security has attracted a population particularly in urban areas prefer residential schemes that offer a gated and guarded security system. Apart from the multi-storey residential scheme (high rise) strata-titles, landed residential development (landed property), which introduced the concept of Gated Community (GC) and Guarded Neighbourhood (GN) become popular choice and attract residents.

2. This has led to amendments to the Strata Freehold Act 1985 (Act 318) in 2007. The provisions of subsection 6 (1A) of the Act 318 permit landed residential scheme (landed), which is built on one main lot (master title) broken up into small parcels of land (land parcels) of land holdings in the strata title.

3. Apart from the existence GACOS which is basically consistent with the provisions of Act 318, GN schemes also form in areas of existing housing and new residential areas whether in urban or in the suburbs.

4. Since the growth of GC and GN scheme continued widespread in areas of existing and new housing, the formulation of guidelines for the control of its existence is necessary. The move will help the process of consideration of the application and enforcement of the GC scheme GN schemes by local authorities (PBT).

5. GC can be interpreted as a population group living in the gated and guarded either in multi-storey residential buildings (high-rise property) such as apartments, condominiums and townhouses in a residential area or landed (landed property), such as bungalows, terraced and detached houses. However, the understanding of the GC in the context of Malaysia focused on population groups or communities who live in strata-titled landed houses.

6. GN can be interpreted as a residential area controlled in whole or in part in schemes to existing or new housing that withholding the individual's right to land (individual land title). GN scheme to provide security services either with or without a guard. In terms of law, it cannot have physical barriers and to enforce any restrictions on entry and exit of the occupants and the public.

7. The general guidelines include aspects of planning control such as the placement location, minimum wide area, common property facilities, the construction of the wall / fence and the needs of Social Impact Assessment (SIA).

8. Specific guidelines covering 14 of planning control as follows:
(i) Size of Development Area
(ii) Site Planning
(iii) Location Development
(iv) And the Road Hierarchy
(v) Shift Design Housing and Building
(vi) Construction of Fence / Wall
(vii) Exit-Login
(viii) Construction of Guardhouse
(ix) Landscape and Tree Planting
(x) Height of Building
(xi) Provision of Parking / Motorcycle
(xii) Special route Utilities
(xiii) Placement of Public Utilities
(xiv) Name of Park / Neighbourhood

9. Guidelines of Guarded Neighborhood covers six aspects of planning and control, establishment of basic conditions, control guard building, fencing control, security requirements and condition of the release status.

Membership

1. Membership is open for residents of Taman Bukit Minyak Utama, that are of age 21 and above, and are Malaysian citizens.

2. Only one member from each residence is permitted to join the Organization.

3. Each membership application must be proposed and supported by two members and the application has to be referred to the secretary who must, as soon as possible, present it to the committee for approval. The committee’s decision is final.

4. Each applicant whose application has been approved in the above manner, must, on completion of payment of entrance and first monthly fees, be accepted as a member of the organization and shall have the rights of a member.

Entrance Fees, Fees and other payments

1. Entrance fees RM 50.00 (Fifty Ringgit Malaysia only).

2. Monthly security fees RM50.00 (Fifty Ringgit Malaysia only).

3. Car sticker, 2 pieces for RM10.00 (Ten Ringgit Malaysia only).

4. Member can purchase extra car stickers, the price is RM5.00 per sticker. (Five Ringgit Malaysia only).

5. Members that have debts for more than three months will automatically be removed from the membership and the committee shall be allowed take legal action in regards to such debts, with the condition that the offending member has received the appropriate notices beforehand.

6. The committee has the right to state the amount to be charged for entrance fees for re-entry to the Organization for those members who have lost their member’s rights through unpaid debts.

7. Special fees or money can be collected from the members for certain events with the agreement of the members in the annual general meeting. If any member fails to make the payment in the specified period of time, then the failure would be considered as a debt in the monthly fees.

Resignation and termination of members

1. A member must provide a written resignation letter to the secretary two weeks prior to the resignation and must settle any outstanding debts prior to acceptance of the member’s resignation.

2. Members that fail to adhere to the Constitution of the Organization or that damage the good name of the Organization shall be dismissed or suspended as a member for a period of time as set by the committee. The offending member must be informed of the reason(s) for such dismissal or suspension prior to any action being taken.
The member must also be given a chance to explain his/her reasons and defend his/her stand. Dismissal or suspension of the member shall be carried out unless decided otherwise at the Annual General Meeting which may postpone or cancel the decision based on the member’s appeal.
